By accessing or using the Symphonix Health website (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Website. If you are using the Website on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

The Website is provided for informational purposes and to facilitate access to Symphonix Health products and services. You agree to use the Website only for lawful purposes and in accordance with these Terms.

The Symphonix Health name, logo, brand elements, website design, and proprietary content are the intellectual property of Symphonix Health. All rights are reserved unless explicitly granted through separate written agreements.

The following are trademarks of Symphonix Health: BulletTrain™, GHARRA™, Nexus A2A™, Bevan LLM™, SignalBox™, Patient360™, Grounded Clarity™, and BulletLink™. All Symphonix Health trademarks are protected under common law.
Use of Symphonix Health products (including BulletTrain, Nexus A2A, and GHARRA) does NOT grant rights to use Symphonix Health trademarks. You may describe your use of the products but may not use Symphonix Health trademarks in your product name, company name, or domain name without written permission.

Important: Different Symphonix Health products are subject to different terms as described below.
BulletTrain is free to install and self-host. Your use of BulletTrain is subject to the Symphonix Health product licence terms included with the software. Enterprise deployments with production support, sovereign deployment, and custom SLAs require a separate enterprise agreement.
The Nexus Agent-to-Agent (A2A) Protocol is a governed protocol standard maintained by Symphonix Health. Your use of the Nexus protocol is subject to the Symphonix Health protocol terms.
GHARRA is a managed service hosted by Symphonix Health, charged per agent usage. Your use of GHARRA is governed by the Symphonix Health managed service terms. An integration bridge connects BulletTrain deployments to the GHARRA managed service.
Free-tier products are provided "as is" without warranty of any kind. Enterprise customers receive warranties and SLAs as specified in their enterprise agreements.
Important: Enterprise use of BulletTrain and other proprietary Symphonix Health products requires a separate licence agreement. These Terms do not grant any licence to use enterprise software.
BulletTrain is a proprietary enterprise product. Access to BulletTrain for evaluation or production use is subject to a separate Enterprise Licence Agreement. Contact us at info@symphonix-health.com for licensing enquiries.

To the fullest extent permitted by applicable law, Symphonix Health, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of or inability to use the Website, regardless of the theory of liability.
In no event shall our total aggregate liability exceed one hundred euros (EUR 100) or the amount you have paid to Symphonix Health in the twelve months preceding the claim, whichever is greater.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
You agree to indemnify, defend, and hold harmless Symphonix Health and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of the Website.
These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at info@symphonix-health.com. We will attempt to resolve the dispute through good-faith negotiation within 30 days. If the dispute is not resolved informally, either party may pursue formal legal proceedings in accordance with Section 12.
Symphonix Health reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Website after such changes constitutes acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with the Privacy Policy and any applicable product licence terms or separate enterprise agreements, constitute the entire agreement between you and Symphonix Health regarding the use of the Website.
